NHS England is acting unlawfully by failing to properly involve and inform patients about its primary care commissioning decisions, a High Court judge has said.

In a ruling with wide ranging implications for the commissioning body, Justice Popplewell last week found NHS England had and continued to flout key sections of the NHS Act.

GMB Members Join Photocall At Parliament On 19th Nov And Vigil On 20th Nov To Boost Support For NHS Bill On 21st November

Clive Effordís Private Memberís Bill is trying to undo the most damaging aspects of this legislation and all MPís should vote to support it urges GMB.

1. The Bill seeks to repeal the most damaging aspects of the Health and Social Care Act.
Return to the Secretary of State the responsibility to guarantee comprehensive healthcare, free at the point of need.

Put patient care before private profit, protecting our NHS from the competition-led race to the bottom opened up in the Health and Social Care Act.

Limit the amount of income NHS trusts can make from private patients, ensuring NHS patients are not forced to the back of the queue behind paying customers.

Give Parliament sovereignty over the NHS so that any future treaties or trade agreements (like TTIP) would have to be debated and voted on in Parliament before they can apply to the NHS.

According to research by the NHS Support Federation, since 2013 when the Health and Social Care Act 2012 came into effect, over £7 billionís worth of NHS contracts has been put out to competitive tender. Of this, 56 per cent of the contracts put out to tender have been won by private providers.

GMB To Join Vigil Outside Parliament On 20 November On Eve Of Debate On New Draft Legislation To Rescue NHS From Competition Quagmire

Tory and Lib Dem MPs will have to answer to their constituents if they donít take chance in upcoming Commons vote to undo damage done to NHS, says GMB

GMB members will join an NHS vigil on 20th November at 7pm outside the Houses of Parliament on the eve of the second reading of the National Health Service (Amended Duties and Powers) Bill on 21 November 2014.

This bill published today is a Private Members Bill put forward by Labour MP Clive Efford unpicks the hugely controversial Tory-Lib Dem reorganisation of the NHS. See notes to editors for link to text of the bill. The National Health Service (Amended Duties and Powers) Bill is backed by the Labour Party.

Rehana Azam, GMB National Officer for the NHS, said ďClive Effordís draft Bill is an important moment in the growing campaign to restore a publicly run NHS.

Backbench Tory and Lib Dem MPs will have to answer to their constituents if they donít take this chance to undo the damage done by the coalitionís hugely controversial changes.

We are moving into a government-induced NHS crisis this winter. Health workers are taking a second wave of industrial action in the week commencing 24 November in a dispute over pay.

Since the coalition pushed through the Health and Social Care Act in 2012, NHS services have been sold off at an alarming rate. We have seen almost £12.5 billion worth of NHS services put out to market and some 70% of contracts handed to the private sector. GMB campaigned against the Tory-Lib Dem reforms from the beginning.

The NHS should be the provider of health services and alternatives desperately need to be found to the toxic PFI contracts that NHS trusts simply can't manage.Ē
